Welcome to Sample Monsta! These Terms of Service ("Terms") govern your use of the Sample Monsta software application and related services (collectively, the "Service") provided by Gabriel Santiago DBA Muzik Society ("we," "us," or "our"), a sole proprietorship based in Medellin, Colombia.
By accessing or using Sample Monsta, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
Sample Monsta is an intelligent drum library manager designed for music producers. The software helps you organize, manage, and creatively work with your drum sample collections, providing tools to make music production swifter, more creative, and organized. Muzik Society also develops additional products (including SAMPL4R and future plugins) that operate under the same account and licensing system described in these Terms.
You must be at least 13 years of age to use Sample Monsta. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.
To access certain features of Sample Monsta, you must create an account. When registering, you agree to:
You are responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information.
Your access to each Muzik Society product is governed by a license tied to your account. Licenses are per-product; the same account may hold licenses for multiple products (such as Sample Monsta, SAMPL4R, and future products) simultaneously.
Sample Monsta offers two categories of free license depending on when the account was created. Both are complimentary, non-transferable, and non-sublicensable.
New accounts created on or after July 10, 2026 receive a PROMO2 trial license valid for 7 days from account creation. The PROMO2 license does not renew through app usage and does not qualify for the inactivity-grace period described in Section 4.2. At the end of the 7-day trial window the license enters an expired state and the application will no longer validate against Sample Monsta’s servers.
Upgrade paths from an active PROMO2 trial:
Accounts created before July 10, 2026 received a PROMO partner license which remains active through continued use of the software. This license does not have a fixed expiry date and is maintained under the active-use rules in Section 4.2. Existing PROMO license holders are grandfathered on these terms and are not affected by the introduction of the PROMO2 trial for new signups.
The PROMO license described in 4.1(b) is maintained through active use. If you do not launch or validate the application for 10 consecutive days, the license enters an expired state. Supporters (users who have made any prior donation) receive an extended 20-day grace window. Reactivating an already-expired PROMO license requires a donation (any amount) or a perpetual license purchase.
The PROMO2 trial license described in 4.1(a) does not qualify for this active-use grace period; it expires on a fixed 7-day schedule regardless of usage.
You may convert a PROMO or PROMO2 license to a perpetual license through a one-time purchase. A perpetual license never expires due to inactivity and remains valid for the version of the software purchased and all subsequent updates released while the license is active.
Your license is bound to specific hardware for activation purposes. Each license may be activated on a limited number of devices. Changing hardware may require reactivation or contacting support. We reserve the right to limit or revoke licenses that show unusual activation patterns indicating abuse.
You may NOT:
We may modify the duration of free or trial access, the inactivity grace period (currently 10 days for free users, 20 days for Supporters), eligibility for promotional (PROMO) licenses, the scope of free features, the post-expiration reactivation paths, and other license terms at any time, effective on reasonable notice. Material changes will be reflected in an updated version of these Terms (see "Changes to These Terms"), and continued use of the Service after the effective date constitutes acceptance of the revised Terms.
All purchases are currently processed through PayPal Checkout. PayPal handles payment authorization, fraud screening, currency conversion at checkout, and chargeback administration on our behalf. By completing a purchase you agree to PayPal’s User Agreement and acknowledge that your payment instrument relationship for the transaction is with PayPal.
Purchases made on or before June 19, 2026 may have been processed by our previous provider Paddle.com as Merchant of Record under their Checkout Buyer Terms. Those legacy transactions remain governed by Paddle’s buyer terms for their original processing; ongoing service delivery and support are provided directly by Sample Monsta under these Terms.
Sample Monsta is responsible for delivery of the licensed software, customer support, and the Refund Policy below. Sample Monsta operates as the merchant for current PayPal-processed transactions; we collect and remit applicable taxes where required by law in our operating jurisdiction.
Refund eligibility, the request process, processing timelines, and exclusions are described in our Refund Policy. In summary: a full refund is available within 14 days of purchase for any reason; after 14 days we still consider refunds on a case-by-case basis for documented technical issues. Donations and tips are voluntary and non-refundable except in the case of accidental duplicate payment.
To start a refund request, email [email protected] with your order ID and the email address used at checkout. We acknowledge requests within 3 business days.
Any donations or tips made through the Service are voluntary and entirely non-refundable, except in cases of accidental duplicate payment. They do not entitle the sender to any additional license rights, features, or services beyond what is already automatically granted by the donation tier thresholds documented at checkout.
When using Sample Monsta, you agree not to:
Sample Monsta and all other Muzik Society software products, including all code, graphics, user interface design, and content, are owned by Gabriel Santiago DBA Muzik Society and protected by copyright, trademark, and other intellectual property laws. The license granted to you does not transfer any ownership rights in the software.
You retain full ownership of any audio, samples, and music you create or process using Sample Monsta. We claim no rights whatsoever to your creative output. The software processes your audio files locally on your device; we do not access, scan, upload, or claim any interest in your content.
You may stop using Sample Monsta at any time. To delete your account, please contact us at [email protected].
We may suspend or terminate your access to Sample Monsta if:
Upon termination, your license to use Sample Monsta ends immediately. Sections regarding intellectual property, disclaimers, limitations of liability, indemnification, and governing law survive termination.
SAMPLE MONSTA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
To the maximum extent permitted by applicable law, Muzik Society shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of Sample Monsta, even if advised of the possibility of such damages.
Our total aggregate liability for any and all claims arising from your use of the Service shall not exceed the amounts you paid to us in the twelve (12) months preceding the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless Muzik Society and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
These Terms shall be governed by and construed in accordance with the laws of the Republic of Colombia, without regard to its conflict of law provisions. For international users, applicable mandatory consumer protection laws of your jurisdiction may also apply where required by law.
Any disputes arising from these Terms or your use of Sample Monsta shall first be attempted to be resolved through good-faith negotiation by contacting us at [email protected]. If negotiation fails, disputes shall be resolved through the courts of Medellin, Colombia, unless your local mandatory laws require a different jurisdiction.
To the extent permitted by applicable law, you agree that any disputes will be resolved on an individual basis and not as part of any class, consolidated, or representative action.
We reserve the right to modify these Terms at any time. The current version identifier is shown in the "Last Updated" block at the top of this page. When we make material changes, we will bump the version identifier and:
Your continued use of Sample Monsta after changes become effective constitutes acceptance of the revised Terms.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Muzik Society regarding Sample Monsta and the Service.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
